Collect and use personal data of job applicants, temporary/payroll employees, trainees and employees.
Please note that we will collect and use the personal data you provide to us because this is necessary for the completion of the application procedure or to conclude and execute a (possible) employment contract / internship agreement / temporary employment contract. In addition, certain personal data are required for the fulfilment and implementation of provisions of the collective labour agreement applicable to us. We also collect and use your personal data to comply with certain legal obligations. These legal obligations relate, for example, to the determination and liability of taxes and employee contributions.
Given this necessity, you are obliged to provide us with the personal data required for this purpose. If you do not or insufficiently provide us with personal data, we may not be able to go through a job application procedure with you, enter into and execute an employment contract / internship agreement / agency agreement (if any) with you or fulfil our legal obligations.
If you are a (payroll) employee or trainee, we will use your data for the drafting, execution and termination of the employment or trainee agreement or employment relationship. This includes:
If you are an applicant, we will use your data to communicate with you about the course of the application process, the assessment of your suitability for a position that is or may become vacant.
If you are a temporary employee, we will use the data we obtain from the temporary employment agency to assess your suitability for a position that is or may become vacant and to execute the temporary employment contract.
Passing on to third parties
We may transfer your personal data to other parties. These other parties may be government bodies, but also parties who carry out work on our instructions or parties to whom we are obliged to provide data in connection with the (execution of the) employment contract. These parties are the following:
Sometimes, providing your data to another party will be necessary to comply with the law, as is the case with transfers to the Tax Office, the UWV, the occupational health and safety service/company doctor, the (compulsory) Pension Fund and the Social Affairs and Employment Inspectorate.
In other cases, the transfer is necessary to execute the (employment) agreement with you, such as in the case of transfer to the leasing company. When passing on your data to our absenteeism insurer, we have a legitimate interest, namely that it enables us to claim an insurance payment.
There are also parties who carry out work on our behalf, such as the accountant/salary administrator. We have a legitimate interest in this transfer of your data. This work is outsourced because of (among other things) the knowledge and expertise that our accountant/salary administrator possesses. In order to execute the (employment) agreement with you, the accountant/salary administrator needs your personal data.
Furthermore, we use external server space for the storage of (parts of) our personnel and payroll administration, which includes your personal data. Your personal data are provided to our server provider for this reason. We also use Microsoft Office and its storage facilities for e-mails and other files. We have a legitimate interest in these two transfers, as we want to store and process data digitally and outsourcing this has several advantages.
Retention period of personal data
By agreeing to this privacy statement, you consent to the retention of your application data for a period of up to two years.
If the application results in employment with HAAN, personal data from the payroll that is relevant for tax purposes will be retained for a period of seven years after you leave employment. This retention period is linked to a legal obligation applicable to us. We will retain payroll tax statements and a copy of your identity documents for five years after the end of your employment. This retention period is also related to a legal obligation applicable to us.
For other data from the personnel or payroll administration, we apply a retention period of no more than two years after your employment is terminated, unless it appears that certain personal data are necessary for us to comply with a legal (retention) obligation or in the event of an employment conflict or lawsuit. By 'other personnel or payroll data', you should think, for example, of employment contracts, reports of assessment and performance interviews, correspondence on appointment, promotion, demotion and dismissal, certificates and administrative absence data.
Your rights
You have the right to ask us to access your own personal data. If warranted, you may also ask us to supplement your personal data or amend inaccuracies. In addition, you have the right to ask us to delete your personal data or restrict the use of your personal data. You can also object to the collection and use of your data with us. Finally, you can request us to obtain your personal data or transfer it to another person.
You cannot exercise the above rights in all circumstances. For example, if we need your personal data to comply with the law, you cannot object or request erasure.
